Article 1 - Scope

These terms and conditions of sale apply to products sold on the Athenaeum website belonging to Athenaeum - S.A.R.L. A.V.V. or by telephone and are applicable to the exclusion of all others, in particular those governing in-store sales.

Article 2 – Acceptance

The customer's acceptance of these terms and conditions is materialized by his electronic signature concretized by the validation click, as well as by the communication of his bank details for the purpose of payment of his order.

This electronic signature is equivalent to a handwritten signature between the parties. This dual approach is equivalent to the client's acknowledgment that he has fully read and unreservedly agrees with all of these conditions.

Article 3 - Orders

Orders are placed on the Athenaeum website. The contractual information, written in French, will appear on the order confirmation document.

The validation of your order implies full and complete acceptance of these terms and conditions of sale.

The sale will only be concluded as of the confirmation of the order by Athenaeum - S.A.R.L. A.V.V..

Athenaeum reserves the right to refuse an order from a customer with whom there is a dispute regarding a previous order.

Pursuant to Article L221-5 of the French Consumer Code, the customer has a period of 14 clear days to exercise his right of withdrawal without having to provide justification or suffer penalties. The customer will then be reimbursed (with the exception of the costs of returning the product, which remain the responsibility of the customer). The conditions are defined in Article 14 of these General Terms and Conditions of Sale.

Items must be returned in their original intact packaging, along with any accessories, or documentation. Products must be in perfect condition, unopened and unused.

Return shipping costs are the responsibility of the customer. The refund will be made after recovery of the goods, subject to their good condition, within 10 days from the receipt of the returned products.

Article 4 - Products

The presentation photographs illustrating the products offered in the electronic catalogue of our Athenaeum website aim to describe and present the items with the greatest accuracy. However, a supplier, a vigneron, a producer or a merchant may have to slightly modify the product or the presentation label, in particular for a new vintage for wines and spirits.

Therefore, these photographs cannot be considered as falling within the scope of the contract and variations in the representation of the articles can neither engage the responsibility of Athenaeum - S.A.R.L. A.V.V. nor affect the validity of the sale.

Article 5 - Availability

Athenaeum - S.A.R.L. A.V.V. cannot guarantee the availability of the entire catalogue presented online. Our product offers and prices are valid as long as they are on the site, while stocks last. Indications on the availability of the products are provided to the customer at the time of placing their order, subject to error.

For certain references, the Athenaeum website reserves the right to limit the quantity ordered per customer, per order or per delivery point.

In the event of unavailability after placing their order, we will inform the customer by email, your order will be immediately cancelled and refunded if applicable.

In any case, no compensation can be paid.

Purchases of pre-order, en primeur or future vintages for wines and spirits that are offered on our site will be shipped as soon as they become available. Athenaeum - S.A.R.L. A.V.V. cannot be held responsible for any delay in the marketing date by the winegrowers.

Article 6 - Prices

Our prices are indicated in euros, all taxes included, including the VAT of the country of delivery for France and other countries of the European Union and excluding VAT for international (excluding preparation and shipping costs which are dependent on the shipping area and calculated before confirmation of the order).

Prices may be updated at any time without notice, but items are charged based on the current price, displayed at the order confirmation.

Article 7 - Shipping costs

Shipping costs are calculated as accurately as possible based on your delivery address, the total weight/volume of your order and the number of products. You can get an estimate of this by putting together a basket with the items you are interested in.

Article 8 - Delivery

Once the order has been confirmed, Athenaeum - S.A.R.L. A.V.V. undertakes to hand over to its carrier within 12 to 48 hours, all references ordered by the buyer. (with the exception of pre-orders of products and wines and spirits, en primeur or future vintages). 

For deliveries in Metropolitan France, the products ordered are delivered, at the customer's choice, to the address or relay point he designated when ordering.

Athenaeum offers home delivery against signature in 24 to 72 hours from Monday to Friday (excluding public holidays), with the carriers of the GeoPost network (Colissimo, DPD, Chronopost). The price of delivery on Athenaeum is indicated in your shopping cart as and when items are added to it and according to the destination country indicated in the delivery address

Shipping costs include the cost of packaging and shipping the items. The general order processing time is 24 hours. All orders placed before 12:00 noon Monday to Friday will be dispatched the same day. Orders placed after 12:00 noon or on Saturdays and Sundays will be processed the next day or Monday for orders placed over the weekend.

Any customs fees or local taxes for deliveries outside Metropolitan France remain the responsibility of the recipient, who is then the importer. For shipments outside the European Union and French overseas territories, the price will be calculated automatically on the invoice excluding taxes. Customs duties or other local taxes or import duties or state taxes may be payable. These fees and sums do not fall under the jurisdiction of the athenaeum.com site. They are your responsibility and responsibility, both in terms of declarations and payments to the competent authorities and/or bodies in your country.

All products are carefully packed at our premises and handed over to our carrier. You will be informed by email of the processing of your order, and receive the tracking code of your package as soon as it is handed over to the carrier. 

GeoPost

In order to offer you the best delivery service, Athenaeum has chosen to opt for fast and secure delivery from the carriers of the GeoPost network.

The products can only be delivered to the delivery address indicated by the customer during the ordering process. The information provided by the customer when placing an order is binding on the customer: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

In case of shipping delays, you will be notified by email. In this case, and as long as the product is not shipped, you can cancel your order.

Orders not served within 30 days will be cancelled unless otherwise stated.

The customer must notify the carrier and Athenaeum of any reservation on the delivered product (damaged package, already opened.) within 24 hours of receipt of the product.

The recipient shall address his complaint to the Athenaeum:

    Directly by email or any other electronic means
    No later than the day after delivery before 12:00 noon

Evidence to be provided by the recipient:

    Photos of the goods,
    Photos of the damage,
    Pictures of the packaging,
    Pictures of the shipping label
    Copy of the order invoice

Goods and packaging must be kept until the carrier passes through for inspection

Otherwise, the goods are deemed to have been delivered in good condition.

In the event of apparent defects, the customer has the right of return under the conditions set out in this document.

Article 9 – Protection of minors

Article 93 of the HPST Act amended the provisions of the Public Health Code on the sale of alcohol to minors. The sale of alcohol is prohibited to those under 18 years of age

At the time of registration, the customer must acknowledge that he or she has reached the age of majority. In addition, with each order, at the time of validation and before payment, the customer will accept these general terms and conditions of sale and will again acknowledge his or her majority.

Article 10 – Force majeure

The following are considered to be cases of force majeure relieving the seller of his obligation to deliver : war, riot, fire, strikes, accidents, pandemic and the impossibility of being supplied.

Article 11 – Payment

Orders are invoiced and payable in euros.

The order validated by the customer will only be considered effective when the bank payment centres concerned have given their approval. In the event of refusal by these centres, the order will be automatically cancelled and the customer will be notified by e-mail.

Payment is made by credit card (Visa, Eurocard, Mastercard), PayPal, bank transfer or check. In case of payment by bank transfer, Athenaeum reserves the right to cancel the order if the transfer has not been received within 72 hours. In case of payment by cheque, the company reserves the right to cancel the order if the cheque is not received within 5 working days.

For payments by bank transfer or cheque, delivery takes place as soon as we receive it.

Article 12 - Securing payments

Payment by credit card on the Athenaeum website is fully secure and encrypted by our banking institution. Sensitive information transmitted at the time of payment is SSL encrypted.

Article 14 – Right of withdrawal

14.1 Right of withdrawal and return policy.

You have a right of withdrawal of thirty to 14 calendar days from the date of invoice. During this period, you will be able to return the products without having to justify any reasons or pay a penalty; You will be responsible for the return shipping costs.
To exercise your right of withdrawal, you can use the standard withdrawal form to be filled in here, i.e. make any declaration indicating your intention to return the product to us.
Returns must be for new items (unused product) along with any accessories, instructions for use and documentation.
Items returned incomplete, damaged, or soiled will not be returned.

14.2 Refund.

Athenaeum - S.A.R.L. A.V.V. undertakes to reimburse you for the returned products, subject to compliance with the conditions mentioned above.
The refund will be made within 10 days via the payment method used for the returned order.

Article 15 - Legal guarantee of conformity

Athenaeum - S.A.R.L. A.V.V. is liable for the non-conformity of the goods with the contract under the conditions of Article L. 211-4 et seq. of the Consumer Code and for hidden defects of the goods sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.

If you are acting under a legal guarantee of conformity, you:

  • have a period of two years from the delivery of the property to take action;
  • may choose between repair or replacement of the good, subject to the cost conditions set out in Article L. 211-9 of the Consumer Code;
  • are exempted from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods if they are new, or the six months following the delivery of the goods if they are second-hand.

This legal guarantee of conformity applies independently of any commercial guarantee granted.

You may decide to implement the warranty against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code and, in this case, you may choose between rescission of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Article L217-4 of the French Consumer Code
The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility.

Article L217-5 of the French Consumer Code
The property complies with the contract:
(1) If it is suitable for the use usually expected of similar property and, if applicable:
- whether it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
- whether it has the qualities that a buyer can legitimately expect in the light of public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L217-12 of the French Consumer Code
The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.

Article L217-16 of the French Consumer Code
If, during the course of the commercial warranty granted to the seller on the acquisition or repair of movable property, the buyer requests the seller to repair the condition covered by the warranty, any period of immobilization of at least seven days shall be added to the remaining term of the warranty.
This period runs from the date of the buyer's request for intervention or from the making available for repair of the goods in question, if such provision is subsequent to the request for intervention.

Article 1641 of the Civil Code
The seller is bound by the warranty in respect of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish that use that the buyer would not have acquired it, or would have given only a lower price for it, if he had known of them.

Article 1648 of the Civil Code (first paragraph)
The action resulting from redhibitory defects must be brought by the purchaser within two years of la découverte of the defect.

Article 16 - Disputes

In the event of a dispute, French law applies.

In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator. The matter must be referred to the mediator within a maximum period of one year from the date of the initial complaint.
