Article 2 – Acceptance
The customer's acceptance of these conditions is evidenced by his electronic signature, confirmed by the validation click, as well as by the communication of his bank details for the purpose of payment of his order.</p >
This electronic signature has the value of a handwritten signature between the parties. This double approach is equivalent to the customer recognizing that he has fully read and unreservedly approves all of these conditions.
Article 3 - Orders
Orders are placed on the Athenaeum website. The contractual information, written in French, will appear on the order confirmation document.
The validation of your order assumes full acceptance of these conditions of sale.
The sale will only be concluded upon confirmation of the order by Librairie Athenaeum - S.A.R.L. A.V.V.
Athenaeum reserves the right to refuse an order from a customer with whom there is a dispute regarding a previous order.
Under article L221-5 of the Consumer Code, the customer has a period of 14 clear days to exercise his right of withdrawal without having to provide justification or suffer penalties. . The customer is then reimbursed (with the exception of the cost of returning the product, which remains his responsibility). The conditions are defined in article 14 of these general conditions of sale.
Items must be returned in their original packaging intact, accompanied by all their possible accessories, or documentation. The products must be in perfect condition, neither opened nor used.
Return costs are the responsibility of the customer. Reimbursement will take place after recovery of the goods, subject to their good condition, within 10 Days from receipt of the returned products.
Article 4 - Products
The presentation photographs illustrating the products offered in the electronic catalog of our Athenaeum site tend to describe and present the items with the greatest accuracy. However, a supplier, a winegrower, a producer or a trader may have to slightly modify the product or the presentation label, in particular for a new vintage for wines and spirits.
These photographs cannot therefore be considered as entering into the contractual field and variations in the representation of the articles cannot engage the responsibility of Librairie Athenaeum - S.A.R.L. A.V.V. nor affect the validity of the sale.
Article 5 - Availability
Librairie Athenaeum - S.A.R.L. A.V.V. cannot guarantee the availability of the entire catalog presented online. Our product offers and prices are valid as long as they are on the site, while stocks last. Indications on the availability of the products are provided to the customer at the time of placing his order, subject to error.
For certain references the Athenaeum site reserves the right to limit the quantity ordered per customer, per order or by delivery point.
In the event of unavailability after placing his order, we will inform the customer by email, your order will be immediately canceled and refunded if necessary.
In any case, no compensation may be paid.
Purchases of pre-order, en primeur or future vintage products for wines and spirits that are offered on our site will be shipped as soon as they are available. Athenaeum Bookstore - S.A.R.L. A.V.V. cannot be held responsible for any delay in the marketing date by the winegrowers.
Article 6 - Price
Our prices are indicated in euros, all taxes included, including the VAT of the country of delivery for France and the other countries of the European Union and excluding VAT for international (excluding shipping costs). preparation and shipping which are dependent on the shipping zone and calculated before confirmation of the order).
Prices may be updated at any time without notice, but the items are invoiced on the basis of the current price, displayed at the confirmation of the order.
Article 7 - Shipping costs
The shipping costs are calculated as accurately as possible according to your delivery address, the total weight/volume of your order and the number of products. You can get an estimate by putting together a basket with the items that interest you.
Article 8 - Delivery
After confirmation of the order, Athenaeum - S.A.R.L. A.V.V. undertakes to deliver to its carrier within 12 to 48 hours, all references ordered by the buyer. (with the exception of pre-orders of products and wines and spirits, new wines or future vintages).
For deliveries in Metropolitan France, the products ordered are delivered, at the customer's choice, to the address or to the relay point he designated when ordering.
Athenaeum offers home delivery against signature in 24 to 72 hours from Monday to Friday (excluding public holidays), with GeoPost network carriers (Colissimo, DPD, Chronopost). The price of delivery on Athenaeum is indicated in your basket as items are added to it and according to the country of destination indicated in the delivery address
Shipping costs include the costs of packaging and shipping the items. The general order processing time is 24 hours. All orders placed before 12:00 Monday to Friday will be dispatched the same day. Orders placed after 12:00 p.m. or on Saturdays and Sundays will be processed the next day or on Monday for orders placed during the weekend.
All products are carefully packaged at our premises and handed over to our carrier. You are informed by email of the processing of your order, and receive the tracking code for your package as soon as it is delivered to the carrier.

In order to offer you the best delivery service, Athenaeum has chosen to opt for fast and secure delivery from carriers in the GeoPost network.

The products can only be delivered to the delivery address indicated by the customer during the ordering process. The information stated by the customer, when taking the order, commits the latter: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.
In the event of a shipping delay, you will be notified by email. In this case, and as long as the product is not shipped, you can cancel your order.
Orders not served within 30 days will be canceled unless otherwise noted.
The customer must notify the carrier and Athenaeum of any reservations about the delivered product (damaged package, already opened.) within 24 hours of receipt of the product.
The recipient will address their complaint to the Athenaeum:

Article 9 – Protection of minors
The provisions of the Public Health Code on the sale of alcohol to minors have been modified in article 93 of the HPST law. The sale of alcohol is prohibited to those under 18 years of age.
When registering, the customer must acknowledge their majority. In addition, with each order, during validation and before payment, the customer by accepting these general conditions of sale will again recognize his majority.
Article 10 – Force Majeure
Are considered as cases of force majeure releasing the seller from his obligation to deliver: war, riot, fire, strikes, accidents, pandemic and the impossibility of being supplied .
Article 11 – Payment
Orders are invoiced and payable in euros.
The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email.
Payment is made by credit card (Visa, Eurocard, Mastercard), PayPal, transfer or check. In the event of payment by transfer, the Athenaeum company reserves the right to cancel the order if the transfer has not been received within 72 hours. In the event of payment by check, the company reserves the right to cancel the order if the check is not received within 5 working days.
For payments by transfer or check, delivery occurs upon receipt.
Article 12 - Payment security

Article 14 – Right of withdrawal
14.1 Right of withdrawal and return conditions.

14.2 Refund.
Athenaeum - S.A.R.L. A.V.V. undertakes to reimburse you for returned products, subject to compliance with the conditions mentioned above.
The reimbursement will be made within 10 days via the payment method used for the returned order.
Article 15 - Legal guarantee of conformity
Athenaeum - S.A.R.L. A.V.V. is liable for defects of conformity of the goods to the contract under the conditions of article L. 211-4 and following of the consumer code and for hidden defects of the thing sold under the conditions provided for in articles 1641 and following of the civil code.
If you are acting as a legal guarantee of conformity, you:
- benefit from a period of two years from the delivery of the property to act;
- can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- you are exempted from providing proof of the existence of the lack of conformity of the good during the twenty-four months following the delivery of the good if it is new, or the six months following the delivery of the good if this one is used.
This legal guarantee of conformity té applies independently of any commercial guarantee granted.
You can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and, in this case, you can choose between the resolution of the sale or a reduction in the sale price in accordance with article 1644 of the civil code.
Article L217-4 of the Consumer Code
The seller delivers goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery.
He is also liable for any defects of conformity resulting from the packaging, the assembly instructions or the installation when this has been made his responsibility by the contract or has been carried out under his responsibility.
Article L217-5 of the Consumer Code
The good complies with the contract:

Action resulting from lack of conformity is prescribed two years from delivery of the goods.
Article L217-16 of the Consumer Code
When the buyer asks the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run.

Article 1641 of the civil code

In the event of a dispute, French law applies.
