Article 1 - Scope
These conditions of sale concern the products sold on the site athenaeum.com and are applicable to the exclusion of all others, in particular those which govern in-store sales. Orders are placed at:

Article 2 - Orders
Orders are placed on the website athenaeum.com. The contractual information, written in French, will appear on the order confirmation document.
The validation of your order implies full acceptance of these conditions of sale.
The Athenaeum reserves the right to refuse an order from a customer with whom there is a dispute regarding payment for a previous order.
Under article L221-5 of the Consumer Code, the customer has a period of fourteen clear days to exercise his right of withdrawal without having to provide justification or suffering penalties. The customer is then reimbursed (with the exception of the cost of returning the product, which remains at his expense).
CDs and DVDs must be returned in their original intact cellophane packaging.
Return costs are the responsibility of the customer. Reimbursement will take place after recovery of the goods, subject to their good condition, by credit card (when possible) or by transfer.
Article 3 - Availability
The Athenaeum cannot guarantee the availability of the entire catalog presented online. Not all of these books are available from their publisher. You will find information on availability on the sheets corresponding to the books you have chosen.
We do not have this entire catalog in stock. The information on this site is valid while stocks last. Information on the availability of titles is given subject to errors. In this case, after checking availability with our suppliers, you will receive an email indicating the delivery time and, in the event of unavailability, your order will be immediately canceled and refunded if applicable.
For products indicated as available to order, the offers on the site are valid provided that the stocks indicated by the publishers are not incorrect.
The Athenaeum undertakes to reimburse any order that cannot be served but cannot pay any compensation in this respect.
Books for pre-order: The upcoming titles offered on this site are shipped from the date they go on sale. The Athenaeum cannot be held responsible for any delay in the marketing date.
Article 4 - Price
Our prices are indicated in euros, all taxes included (excluding preparation and shipping costs which are dependent on the shipping area and are calculated before confirmation of the order).
The books are sold in strict compliance with the legislation on the price of the book, and in particular the Lang Law 81-766 of August 10, 1981 on the single price of the book which states that it is the publisher who sets the price of the book, the bookseller can apply a discount to this price which cannot exceed 5% and only if the book is collected from a bookstore, no discount can be applied when sending it regardless of the way it was sent. ordered..
Prices may be updated at any time without notice, but items are invoiced based on the current price displayed when the order is placed.
Article 5 - Shipping costs
Shipping costs are calculated as accurately as possible based on your delivery address and the total weight of the books in your order. You can get an estimate by putting together a basket with the works that interest you.
Article 6 - Payments
Orders are invoiced and payable in euros.
The amount of the order is payable in full and in a single payment on the date of the order.
Any customs fees or local taxes for deliveries outside mainland France remain the responsibility of the recipient, who is then the importer. For shipments outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall under the responsibility of the athenaeum.com site. They are your responsibility and are entirely your responsibility, both in terms of declarations and payments to the competent authorities and/or bodies in your country.
The products delivered and invoiced remain the property of L'Athenaeum until full payment of the price.
Payment is made by credit card (Visa, Eurocard, Mastercard), by Paypal, by check, or by international transfer.
Payment by credit card is completely secure and encrypted.
With regard to checks or payments by transfer, delivery occurs upon receipt of the check or transfer.
Article 7 - Payment security

Article 8 - Delivery
The Athenaeum, as part of its sales contract, is fully responsible for the delivery and transport of the books, to the address indicated at the time of the order, the inherent costs being incidental to these operations.
The responsibility for the risk of loss or destruction lies with the purchaser upon delivery, even if he is not the owner of the goods delivered. He personally bears any insurance costs.
The delivery time includes the preparation time of the package plus the delivery time. The “Delivery times” section tells you how to calculate your delivery time. Athenaeum cannot be held responsible for any destruction or blocking of the package upon entry into the country of destination.
Article 9 - Delivery times
Shipments are made Monday to Friday (except public holidays).
Any order that reaches us before midday is processed the same day.
The delivery times announced are the average delivery times observed. In some cases, the unavailability of a product may delay the shipment of your package. If you prefer to receive all your books at once, allow for the delivery time that corresponds to the longest among the books you have ordered. To calculate your delivery time, refer to the indication in the book description and add the average delivery time of the package in France:
• by Colissimo or DPD: 48h to 72h
• by Chronopost: 24h to 48h
Internationally, delivery times vary from 3 to 7 working days
Article 10 - Legal guarantee of conformity
“The Athenaeum - S.A.R.L. A.V.V. with capital of €150,000” is liable for defects in conformity of the good with the contract under the conditions of article L. 211-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in articles 1641 et seq. of the civil code.
If you act as a legal guarantee of conformity, you:
• benefit from a period of two years from delivery of the property to act;
• can choose between repair or replacement of the goods, subject to the cost conditions provided for by article L. 211-9 of the code of consumption;
• are exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods if the goods it is new, or the six months following delivery of the good if it is second-hand.
This legal guarantee of conformity applies independently of any commercial guarantee granted.
You can decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the civil code and, in this case, you can choose between cancellation of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.
Article L217-4 of the Consumer Code
The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.
Article L217-5 of the Consumer Code
The property complies with the contract:
1° If it is suitable for the use usually expected of similar goods and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L217-12 of the Consumer Code
The action resulting from the lack of conformity is prescribed two years from the delivery of the goods.
Article L217-16 of the Consumer Code
When the buyer requests from the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, a repair covered by the guarantee, any period of Immobilization of at least seven days is added to the duration of the warranty which remained to run.
This period runs from the buyer's request for intervention or the making available for repair of the good in question, if this making available is subsequent to the request for intervention.
Article 1641 of the civil code
The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would have given only a lower price if he had known them.
Article 1648 of the civil code (first paragraph)
The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
Article 11 - Disputes
In the event of a dispute, French law applies.
In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or response within two months, he can submit his complaint free of charge to the consumer mediator. The mediator must be contacted within a maximum period of one year from the initial complaint.
