The transfer of wine-growing operations is a pivotal moment in the life of a family and territorial business. This collective work, published by the éditions LexisNexis, presents the Proceedings of the SEPAGE conference which was held in Tours on November 15, 2019. It is part of a multidisciplinary research project funded by the Centre-Val de Loire region, dedicated to the study of Career paths in viticulture.
This groundwork is based on nearly forty stories of viticultural transmission, illustrating the diversity of contexts, human issues, and legal realities. The book gives a voice to university legal scholars specializing, but also to some regional practitioners anchored in the daily operations transmissions.
The legal angle is central here: the work is divided into two main parts, first dealing with the private aspects of transmission (family, inheritance, business transfer) then from the Public aspects (taxation, rural law, intervention of local authorities). This dual approach offers a Precious summary of positive law in the field of viticulture and winemaking, while highlighting recent developments and the gray areas of the legal framework.
Far from remaining theoretical, this publication aims to propose concrete avenues for legal tools, directly useful for the Winegrowers, notaries, lawyers, or students in agricultural law. She presents herself as a legal toolbox to support professionals in their transmission processes.
This editorial project was led by Abdelkhaleq Berramdane, Alexandre Deroche, and Fabienne Labelle. It brings together the contributions of many researchers and experts:
Raphaèle-Jeanne Aubin-Brouté, Xavier Auriault, Elie Barbereau, Hubert Bosse-Platière, Samuel Brennetot, François Cazin, Sabrina Le Normand-Caillère, Jean-Christophe Mandard, Michel Pech, Ronan Raffray, François Robbe, Séverine Taphinaud, Luc Tessier…
Beyond technical analyses, this book raises the crucial question of the sustainability of the wine heritage in the territories. He is interested in theWinery as a vector of regional identity, and also addresses the transfer of know-how, a crucial issue in the era of climate and economic changes.
